Please read these Terms carefully. By accessing or using SmokeScreen in any capacity, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must immediately discontinue use of the platform.
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SmokeScreen ("Company," "we," "us," or "our") governing your access to and use of the SmokeScreen platform, software, website, and all associated services (collectively, the "Platform").
By registering an account, purchasing credits, activating your account, or using any feature of the Platform, you unconditionally accept these Terms. Your continued use constitutes ongoing acceptance of any updates to these Terms, which we may make at any time with or without prior notice.
You must be at least 18 years of age to use SmokeScreen. By using the Platform, you represent and warrant that:
We reserve the right to suspend or terminate any account we reasonably believe belongs to a person under the age of 18 or who does not meet eligibility requirements, without notice or refund.
SmokeScreen is a real-time AI transformation and streaming platform designed exclusively for lawful content creation, entertainment, and live streaming purposes.
You are expressly permitted to use SmokeScreen for:
Any use outside these permitted purposes is a material breach of these Terms.
The following conduct is strictly prohibited and constitutes a serious breach of these Terms. You agree that you will not, under any circumstances, use SmokeScreen to:
Important: SmokeScreen has zero tolerance for use of the Platform in furtherance of any fraud scheme,or any activity intended to deceive or harm others. Any such use will result in immediate account termination, reporting to relevant law enforcement authorities, and full cooperation with any resulting investigation.
You are solely and exclusively responsible for all content you create, transmit, stream, or distribute using SmokeScreen, and for all activities conducted through your account.
SmokeScreen is a neutral technology platform. The Company does not monitor, control, or direct the content created by users in real time. Accordingly:
This provision survives the termination of your account and these Terms.
You agree to fully indemnify, defend, and hold harmless SmokeScreen, its founders, officers, employees, contractors, partners, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
Activation Fee: A one-time activation fee unlocks an annual access to the Platform. This fee is non-refundable once your account has been activated and access granted.
Credit Purchases: Credits are consumed during active AI transformation sessions based on usage rates displayed on the Platform. All credit purchases are final and non-refundable except where:
Credit Expiry: Credits do not expire unless your account is terminated for breach of these Terms, in which case all credits are forfeited without refund.
Disputes: Any billing disputes must be raised within 14 days of the relevant transaction by contacting support@smokescreenapp.com. We will not consider disputes raised after this period.
Fraud & Chargebacks: Initiating a fraudulent chargeback or payment dispute is a material breach of these Terms. We reserve the right to terminate your account immediately and pursue recovery of any disputed amounts through legal means.
You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to:
The Company will not be liable for any loss or damage arising from unauthorized access to your account resulting from your failure to maintain credential security.
All technology, software, algorithms, models, designs, trademarks, and content comprising the SmokeScreen Platform are the exclusive intellectual property of the Company or its licensors. Nothing in these Terms grants you any ownership or license to the Platform's underlying technology beyond the limited right to use it as expressly permitted herein.
You may not copy, reproduce, distribute, modify, create derivative works from, or exploit any part of the Platform without our prior written consent.
By using SmokeScreen you consent to the collection and use of your data in accordance with our Privacy Policy. We collect account information, usage data, and payment information necessary to provide and improve the Platform.
We do not sell your personal data to third parties. However, we may share data with law enforcement or regulatory authorities where required by law or where we have good reason to believe a user is engaged in illegal activity.
To the maximum extent permitted by applicable law, SmokeScreen and its founders, officers, employees, and affiliates shall not be liable for any:
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.
Our total aggregate liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total amount you have paid to us in the 30 days preceding the claim.
SmokeScreen operates as a platform and does not actively monitor, review, or control how users apply our tools. We are not in a position to verify the purposes for which the Platform is used.
Where we receive a valid and legally binding request from a court, regulator, or law enforcement authority — such as a court order, subpoena, or equivalent legal instrument — we will respond as required by applicable law. We disclose user information only to the extent required by such legal process, and not beyond it. Where permitted by law and technically feasible, we will attempt to notify where permitted by law and reasonably practicable the affected user before disclosing their information, so they may seek legal remedy if they choose.
We reserve the right to suspend or permanently terminate your account at any time, where reasonably practicable notice, for any breach of these Terms, suspected illegal activity, fraudulent behavior, or any conduct we determine to be harmful to the Platform, other users, or third parties.

You may terminate your account at any time by contacting support@smokescreenapp.com. Termination does not entitle you to a refund of any activation fee or unused credits.
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or your use of the Platform shall first be subject to good faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to binding arbitration or the competent courts of Nigeria, at the Company's election.
You waive any right to participate in a class action lawsuit or class-wide arbitration against the Company.
We reserve the right to update or modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Platform following any update constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SmokeScreen with respect to your use of the Platform and supersede all prior agreements, representations, or understandings, whether written or oral.
